Refunds for services that no longer exist

Q: I applied for a returning resident permit before June 28, 2002. I paid the fee. I was told that under the new law, returning resident permits no longer exist. What will happen to my application?

A: If we did not make a decision on your application before the new law came into force, we will refund the fee paid. This is also true for a Family Business Job Offer.

Refund of Right of Landing Fee for Dependent Children


Q: Why are you refunding the Right of Landing Fee for dependent children?

A: The ROLF has been changed to the Right of Permanent Residence Fee (RPRF) under the new law. You do not have to pay the new fee for dependent children aged 19 and over.

A dependent child may be eligible for a refund of the ROLF if he or she:

was not a refugee;

was at least 19 years old at the time of application for landing; and

arrived in Canada on or after June 28, 2002.


Q: How do I know if I'm eligible for this refund?

A: To be eligible for this refund, you must:

have been a dependent son or dependent daughter aged 19 years or older at the time of application for landing;

not be a spouse of the principal applicant; and

have paid Right of Landing Fee prior to June 28, 2002.


Q: What if I acquired Permanent Residence status before June 28, 2002?

A: You are not eligible for the ROLF refund if you acquired permanent residence before June 28, 2002.


Q: How do I apply for this refund?

A: If you were issued an immigrant visa before June 28, 2002 but did not receive permanent resident status before June 28, 2002, use our ROLF Refund Form.

Note: Use the ROLF Refund Form only if you have not yet received permanent resident status.

If you cannot view the form from our Web site, you can get one at a port of entry. For more information, contact a CIC Call Centre.


Q: What if my application has not yet been finalized?

A: The office that received the payment for sponsorship applications that were not finalized before June 28, 2002 will automatically refund the ROLF.

If your sponsorship application file was sent overseas to process your family members' or relatives' application for permanent residence, you may want to contact the Mississauga Case Processing Centre (CPC) directly to request a refund. You can fax them at 1-905-803-7392 or write to them at:

CIC is developing a strategy to make the appropriate refunds for other types of applications that have not yet been finalized. This page will be updated as new information becomes available.

Q: How do I know if my sponsorship application has been sent overseas for processing?

A: You will receive a letter from CPC Mississauga telling you the decision made on your application. The letter will also give you the address of the Visa Office where your sponsorship application was sent for processing.

Q: How long will it take to receive my refund?

A: It may take up to 120 days from the date we received your refund form to mail your cheque. Please be patient.

Sponsorship and refund

Q: I submitted a sponsorship application for my parents before June 28, 2002, but there is still no decision on my application. I was told that under the new law, CIC would offer a partial refund of the fee, if the sponsor does not meet eligibility requirements. Will you offer me a partial refund if I do not meet the requirements as a sponsor?

A: No, under the new regulations, the sponsorship fees for the principal applicant are paid in two segments. If the sponsorship is not approved, part of that fee is refundable. Because your application was submitted under the old fee regulations, we cannot offer you a refund.
